People’s Choice Undies Run for Bowel Cancer

Terms and Conditions of Participation

Definitions
“People’s Choice Credit Union” a trading name of Australian Central Credit Union Ltd ABN 11 087 651 125, acts under its own Australian Financial Services Licence (AFSL 244310) and Australian Credit Licence
(ACL 244310). It is jointly operating the Undies Run in conjunction with Cancer Council SA (a trading name of Anti-Cancer Foundation of South Australia ABN 31 469 615 538).

“People’s Choice Classic” is the criterion cycling race run on Sunday, 14 January 2018 and is part of the Santos Tour Down Under UCI World Tour event.

“People’s Choice Undies Run for Bowel Cancer” is a mass participation event that runs prior to the People’s Choice Classic to raise money for Cancer Council SA and awareness for bowel cancer on Sunday 14 January at 4:30pm ACDT.

“The Event” refers to the People’s Choice Undies Run for Bowel Cancer.

“Event Organisers” refers to People’s Choice Credit Union and Cancer Council SA who jointly operate the People’s Choice Undies Run for Bowel Cancer.


Registration
1. People’s Choice Undies Run for Bowel Cancer, the Event, is operated jointly by People’s Choice Credit Union and Cancer Council SA, who are the Event Organisers.

2. People’s Choice Undies Run for Bowel Cancer comprises either walking or running the People’s Choice Classic 2.3km street circuit in Adelaide (see map).

3. To enter, participants must complete the online registration form located at www.undiesrun.com.au.

4. Participants under the age of 15 at time of event will be classified as “Children” in the Registration Fee structure and must only choose the Unisex Boxer Short and Unisex Top to be eligible to particate. All participants who are aged up to, and including 7 years at time of the event are classified as Toddlers/Small Children and will therefore only be eligible to register by selecting “Cape” as their garment choice.

5. Website registrations close at 5.00pm on Thursday 11 January 2018. After this date, registrations will be accepted on Event day, at the discretion of the event organiser and subject to the positions available and availability and sizing of merchandise on Event day.

6. The Event Organisers reserve the right, in their absolute discretion, to accept or decline an registration from any person into the Event.


General Conditions
1. The Event Organisers and Events South Australia reserve the right to remove any persons from the Event where they consider it necessary to do so, for health and safety or other reasons.

2. The Event Organisers strongly recommend all participants take out private health cover and Ambulance insurance to cover any unforseen circumstances that may arise.

3. Participants over 15 years of age on Sunday 14 January 2018 can participate in the People’s Choice Undies Run for Bowel Cancer via an individual registration. Participants who are under 18 years of age on 14 January 2018 must have parental/guardian approval to participate and the parent/guardian of the participant must read and agree to these Terms and Conditions of Participation.

4. Participants under 15 years of age on Sunday 14 January 2018 must be accompanied by an adult who has also registered for the event who has sighted the Terms and Conditions on behalf of participants under 15 in same registration. Contact details of the accompanying responsible adult must be supplied as the guardian on registration.

5. Participants with Prams for their children/toddlers will be starting the race 5 minutes after the general race start. The Pram start time will be 4:35pm.

6. The Event Organisers will have the right to approve team names. Team names should not be offensive or conflict with People’s Choice Credit Union, Cancer Council SA or People’s Choice Undies Run for Bowel Cancer sponsors.

7. Participants are responsible for ensuring they are capable of walking or running the Event distance. It is the responsibility of the participant to prepare mentally and physically for the Event.

8. Full payment is required to confirm your registration in People’s Choice Undies Run for Bowel Cancer.

9. Cancellation of the Event may occur if weather conditions prove to be too dangerous. If the Event is cancelled, People’s Choice Undies Run for Bowel Cancer will send an email, notification of the cancellation, if time permits, to all participants and information will be provided at the Event and prior to the Event on www.undiesrun.com.au or by phoning 1300 65 65 85 .

10. Refunds will not be granted due to participant’s cancellation, failure to participate or dissatisfaction by the participant.

11. People’s Choice Undies Run for Bowel Cancer and the Event Organisers in conjunction with Events South Australia will provide medical support.

12. All Event communication will be made via email and the event website. It is the participant’s responsibility to provide a valid email address at the time of registration. If the participant does not have an email address they should make every attempt to read People’s Choice Undies Run for Bowel Cancer website for Event updates.

13. Participants must wear the People’s Choice Undies Run for Bowel Cancer branded “Merchandise” supplied as well as appropriate footwear throughout the entire Event.

14. People’s Choice Undies Run for Bowel Cancer has the right to refuse any personal messaging or branding displayed on or with participants on Event Day that is deemed offensive or in conflict with People’s Choice Credit Union, Cancer Council SA or People’s Choice Undies Run for Bowel Cancer sponsors.

15. Merchandise sizing changes cannot be accommodated.

16. All information in this form is correct at time of printing but may be subject to change.


Changes to the Event
1. The Event Organisers and Events South Australia reserve the right to alter or amend the Event route due to inclement weather and/or extreme heat and other operational needs prevailing at the time and these decisions are always made in the interest of participant’s safety.

2. If the event is cancelled and/or published information needs to change, People’s Choice Undies Run for Bowel Cancer, People’s Choice Credit Union and Cancer Council SA will endeavour to provide a comparable Event as a substitute.

3. The decision to cancel or modify the Event and the Event cancellation process will be in line with People’s Choice Classic, People’s Choice Credit Union, Cancer Council SA and Events South Australia weather policy guidelines. A copy of this policy will be posted on People’s Choice Undies Run for Bowel Cancer website as soon as available.

4. Without limiting the foregoing, People’s Choice Undies Run for Bowel Cancer, People’s Choice Credit Union, Cancer Council SA and Events South Australia are not responsible for third party suppliers of services such as hotels, restaurants, or transportation companies.

 

Participant Waiver
I, the participant named below, hereby acknowledge and agree as follows:
a. I have carefully read, understood and agree to these Terms and Conditions of Participation;

b. I am in sufficiently good physical condition to safely participate in and complete the Event and have no disability, impairment or ailment that will prevent me from safely participating in the Event or that will be detrimental to the health, safety or physical condition of others while participating in the event or while at or near the event.

c. I agree to abide by all the rules and directions of all race officials at the event;

d. I agree that I am responsible for my own medical, personal accident insurance and ambulance cover;

e. I acknowledge that the Event may be cancelled due to inclement weather;

f. I accept that I am not entitled to a refund if I choose to cancel my registration;

g. I will be at least 15 years of age on 14 January 2018. If I am under 18 years old, my parent/guardian gives approval for me to participate and my parent/guardian agrees to these Terms and Conditions of Participation.

h. If I am under 15 years old on 14 January 2018, my accompanying parent/guardian gives approval for me to participate and agree to these Terms and Conditions of Participation on my behalf.

i. I consent to the publication of any photographs taken of me before, during and after the Event for the purpose of promotion of the event, and I consent to my email and mailing addresses and details being added to any mailing lists used by People’s Choice Undies Run for Bowel Cancer, People’s Choice Credit Union and Cancer Council SA.

j. I acknowledge that participation in this Event involves the risk of serious injury or even death from various causes including overexertion, dehydration, accidents with other competitors, spectators, course or weather conditions and other causes.

k. I accept all risks necessarily flowing from my participation in the Event which could result in loss of life or permanent injury.

l. I hereby unconditionally release and forever discharge from all liability all persons or corporations associated directly or indirectly with the conduct of the Event from all claims, suits, demands, expenses, costs, damages or proceedings of any nature whatsoever arising from any personal injury, death, property damage or loss sustained by me as a result of my participation in the event and I hereby agree not to take legal action in connection with the Event or my participation in it. This release shall extend to and include (but not be limited to) People’s Choice Credit Union, Cancer Council SA, People’s Choice Undies Run for Bowel Cancer, Events South Australia, St John Ambulance, South Australian Ambulance Service, South Australian Police, (Insurance Provider), Adelaide City Council, volunteers including medical and paramedical personnel appointed for the Event, the owners, licensees and occupiers of land upon which the Event or any part of it is conducted, any statutory body or local authority having control over any land upon which the Event or any part of it is conducted or which is involved directly or indirectly with the Event in any manner whatsoever and promoters, sponsors and Event organisers. This release continues forever and binds my heirs, executors, personal representatives and assigns.

m. I hereby unconditionally indemnify and hold harmless, and shall keep indemnified and held harmless all persons or corporations associated directly or indirectly with the conduct of the Event against all liabilities, claims, suits, demands, expenses, costs, actions and proceedings of any nature whatsoever that may be brought against the Event Organisers as a result of or in connection with any act, omission, default, failure or error on the part of the Event Organisers as a result of or in connection with act, omission, default, failure or error on the part of the Event Organisers (including any negligent act, omission, default, failure or error) occurring wholly or partly during the event. This release shall extend to and include (but not be limited to) People’s Choice Credit Union, Cancer Council SA, People’s Choice Undies Run for Bowel Cancer, Events South Australia, St John Ambulance, South Australian Ambulance Service, South Australian Police, (Insurance Provider), Adelaide City Council, volunteers including medical and paramedical personnel appointed for the Event, the owners, licensees and occupiers of land upon which the Event or any part of it is conducted, any statutory body or local authority having control over any land upon which the Event or any part of it is conducted or which is involved directly or indirectly with the Event in any manner whatsoever and promoters, sponsors and Event organisers. This release continues forever and binds my heirs, executors, personal representatives and assigns.

Personal information is collected to process donations, issue tax receipts and to send you updates. Your information will be shared between us and we may disclose your information to agents, contractors and third parties who provide services to us, and in doing so we take reasonable steps to ensure any information held by our service providers is protected.
